GENERAL TERMS AND CONDITIONS OF SALE

Welcome to Jalo ! Here are the general terms and conditions of sale, hereinafter referred to as “T&Cs”. If you are looking for particular information that is not included, do not hesitate to write to: admin@jalo-upcycling.com. Thank you!

1. PREAMBLE

These terms and conditions are concluded between:
The micro-enterprise Laurence Hanne, SIRET N° 75137984300020, operator of the site www.jalo-upcycling.com (hereinafter referred to as the “Site”) whose registered office is located at 26 rue de la Patrie, 67300 Schiltigheim, France
Hereinafter referred to as “Jalo”

And:
Any person making a purchase on the Site,
Hereinafter referred to as “the Client”.

The Client declares that he or she has the capacity to enter into this contract, i.e. that he or she is of legal age and that he or she is not under guardianship. The order by the Client implies irrevocable acceptance of these T&Cs. The sales contract is subject to French law.


2. PRODUCTS AND AVAILABILITY

The products offered for sale are those presented on the Site, indicated available at the time of ordering. The products are available within the limit of available stocks, it being specified that Jalo implements all means to ensure that the Site effectively reflects said availability. The products offered for sale are presented and detailed with the greatest possible precision. However, Jalo cannot be held liable in the event of an error or omission in the description of the products. Photographs illustrating the products offered for sale are outside the scope of the contract.
In the event of a debit or collection for the order of an unavailable item, Jalo undertakes to reimburse the Customer within 20 days. Jalo undertakes to notify the Client who has placed an order for an unavailable item by e-mail.


3. PRICES

All prices of the products offered for sale are expressed in euros, including all taxes. Jalo reserves the right to modify the price of any of these products at any time, it being understood that the price actually charged will be the one in force at the time the order is registered.


4. PAYMENT TERMS
All product orders are made exclusively via the Site. Jalo accepts the following payment methods: Visa, MasterCard, American Express, Google Pay, Apple Pay. Jalo reserves the right to condition the acceptance of the order on the fact that any potentially pre-existing dispute regarding the execution of a previous order has been effectively settled.


5. DELIVERY

Jalo delivers in mainland France and all over the world. The products are sent via letters or tracked parcels for which the Customer will receive the contact details, in order to be able to follow their progress. The Client will receive the products within 5 to 8 days for mainland France and within 7 to 15 days for international delivery, following the acceptance and full collection of his payment.

The delivery times indicated on our Site have been communicated to us by the transport providers and are purely indicative. Exceeding these deadlines may not be held against Jalo, nor may it give rise to a termination of the contract or any compensation for damages.

The risks of transport are borne by the Client from the moment of leaving our workshop. The Client must check the condition of the packaging and the conformity of the items delivered and immediately report any anomaly to Jalo. Any reservations must be entered on the delivery note presented by the carrier and must be sent within 48 hours by e-mail to: admin@jalo-upcycling.com.
The goods are shipped from Metropolitan France. If the country of delivery is not part of the European Union, customs duties may be payable to the Client. For a large majority of countries outside the European Union, Jalo includes customs fees in the price of the products. In this case, the Client will not have to pay customs duties at the time of delivery. For other countries that are not covered by this service, the Client will have to pay the customs duties directly to the carrier at the time of delivery. Jalo has no control over these fees which are the sole responsibility of the Client.


6. RIGHT OF WITHDRAWAL AND RETURN OF ITEMS

The Client has a right of withdrawal, which he can exercise without reason, within 7 days of the delivery of the order, which will be exercised by returning at his own expense, new products (in their original packaging, unused) accompanied by the order number to the following address:

Jalo will reimburse the Client for the sums paid, minus shipping costs, with the exception of personalised orders, made at the express request of the Client, unless after discussion with Jalo on the reasons for the withdrawal.
The refund will be made within a maximum of 30 days after receipt of the said products, following the same payment method chosen by the customer at the time of ordering.


7. LIMITATION OF LIABILITY

Jalo is subject to an obligation of means towards the Client. It is expressly agreed that any disruption in the provision of the service for any reason, any external intrusion or infection by a computer virus, shall not engage the responsibility of Jalo. In the event of dissatisfaction for any reason whatsoever, the C lientwill not be able to claim any compensation other than the refund of his order.


8. PERSONAL DATA

The information collected during an order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to Jalo’s service providers involved in the execution of the order. The Client is informed that this same personal data may also be collected by an organization in charge of analyzing orders and combating credit card fraud.
In accordance with the Data Protection Act No. 78-17 of 6 January 1978, the customer has the right to access, rectify, oppose and delete data concerning him.

In order to facilitate your navigation on the Site, Jalo uses cookies or similar systems. These cookies offer you a better quality of service by recording information relating to your browsing.
These cookies do not allow you to be identified individually and their duration is strictly limited to the duration of your browsing session. You can refuse the storage of cookies by adjusting the settings of your internet browser. However, in some cases, this may result in the deletion of all cookies used by the browser, including those used by other websites, which may lead to the alteration or loss of certain settings or information. The deletion of cookies may be likely to modify the quality of navigation on the Site or even make it less fluid.

10. INTELLECTUAL PROPERTY

The content of the Site includes, by way of example and not exhaustively, images, photographs, illustrations, texts, logos, trademarks, videos or any other content. All these elements are the exclusive property of Jalo and no element may be used for any reason whatsoever (copying, adaptation, translation, etc.) by a third party without the express consent of Jalo.
It is strictly forbidden to use or reproduce Jalo’s name, visuals or logo for any reason whatsoever, including advertising purposes, without the prior express consent of Jalo. It is strictly forbidden to misuse the contents of the website.


11. MISCELLANEOUS PROVISIONS

The invalidity or unenforceability of any of the clauses of these T&Cs shall not affect the application or validity of the other clauses of the T&Cs. This clause will then be replaced by the closest possible provision.
Neither Jalo nor the Client may be held liable in the event of contractual non-performance following a case of force majeure, in particular and without limitation in the event of war, riot, insurrection, interruption of transport, import problem, strike, shortage, fire, earthquake, storm, flood.

11. DISPUTES

These T&Cs are governed exclusively by French law. The Commercial Courts of Paris (France) have exclusive jurisdiction in the event of a dispute or dispute concerning them.
